Terms of Service

These are Umbermark's product terms. Umbermark is a Starhold Software product; see also Starhold Software's umbrella terms of service.

1. What Umbermark does

Umbermark scans a Linux server, runs a catalog of hardening checks, and returns a 0–100 score with an evidenced, remediable report. You can scan from the outside (hostname only), by running a read-only script and uploading its output, or by granting a read-only SSH key so we connect from our servers. Umbermark is provided by Copper Jerky LLC, an Arizona limited liability company doing business as Starhold Software (“we”, “us”).

2. Authorization — you may only scan servers you control

You represent that you are authorized to scan every target you submit. Scanning systems you do not own or have explicit written permission to test may violate computer-misuse laws. You are solely responsible for your targets. We may rate-limit, block, or refuse scans we believe are unauthorized or abusive.

Passive external checks (TLS, HTTP security headers and SSH algorithm negotiation, which any browser or client performs) may run against any hostname you submit. Active external checks, which probe ports for exposed services, run only against hosts whose ownership has been verified by serving Umbermark’s verification file from the server itself (a DNS record alone is not sufficient). Never scan hosts you do not control.

Serving the verification file for a hostname is your representation that you control every IP address that hostname resolves to, including any shared or multi-tenant hosting, and you are responsible for the active checks run against those IPs.

3. No warranty; findings are advisory

The service and every report are provided “as is,” without warranties of any kind. A high score is not a guarantee of security, and a finding is not a guarantee of a vulnerability. Umbermark is one input to your own judgment — not a certification, audit, or compliance attestation.

4. Accounts and billing

Sign-in is by email magic link. Paid plans are billed through Polar.sh, our merchant of record; their terms govern the payment itself. You can cancel any time from your dashboard; access continues to the end of the paid period.

5. Acceptable use

Do not use Umbermark to attack, overload, or gain unauthorized access to any system, to evade our rate limits, or to resell the service without agreement.

6. Limitation of liability

To the maximum extent permitted by law, we are not liable for indirect, incidental, special, consequential, or punitive damages, or for any loss of data, profits, goodwill, or revenue, including any loss arising from your use of a scan or report. Our total liability for all claims relating to Umbermark will not exceed the greater of (a) the amount you paid us for Umbermark in the twelve months before the event giving rise to the claim, or (b) one hundred U.S. dollars ($100). Some jurisdictions do not allow certain limitations, so parts of this section may not apply to you.

7. Changes

We may update these terms; material changes will be reflected by the date below. Continued use after a change means you accept it.

8. Governing law and venue

These terms are governed by the laws of the State of Arizona, without regard to its conflict-of-laws rules. You agree that any dispute will be brought exclusively in the state or federal courts located in Maricopa County, Arizona, and you consent to their jurisdiction.
